The Regulator
Not one, for any condition. In November 2025 the FDA’s Digital Health Advisory Committee met specifically on generative-AI mental health devices; a breakthrough designation granted in March 2026 expedites a review, it does not authorise anything. Whatever a product claims, no regulator has yet agreed it can treat.

The Legislators
Illinois and Nevada prohibited AI from delivering therapy or claiming it can. Utah took a different route and required a mental-health chatbot to disclose that it is AI at first contact, on return, and whenever asked. The direction of travel is one way.

The Line, In Statute
It may handle scheduling and billing, and — with the client’s written consent — prepare and maintain notes and records, run ambient documentation, analyse anonymised data and identify referrals. What it may not do is make a therapeutic decision, generate a treatment plan without licensed review, or communicate with a client in a therapeutic role. That division is day 6.
